The Asian International Arbitration Centre (AIAC) introduced the Design and Build Standard Form of Contracts (D&B SFC), launched by the Guest of Honour, YA Dato’ Lee Swee Seng, Kuala Lumpur Construction Court Judge.
Successful coordination of construction projects depends on efficient administration of the contractual chain, including design and build contracts entered into by the Contractors and Sub-Contractors. To address the needs of contracting parties involved in executing design and build works, the D&B SFC aims to complement the initial SFC set and provide smooth administration of contractual relationships.
Addressing problems from its grassroots, the D&B SFC incorporates contractual predictability and time and cost efficiency principles, thereby preventing deadlocks and encouraging continuity of works and working relationships notwithstanding differences that may arise in the course of a project.
Prepared by the Expert Advisory Committee comprising distinguished professionals, the Contracts reflect the best international standards with features such as the possibility of maintaining “Single-Point Responsibility” on the D&B Contractor; the entailment of the Contractor’s responsibility in all aspects of the work; Employer’s responsibility in terms of general contract administration and auditing of Contractor’s works; elemental finalisation of account; and compliance with the Construction Industry Payment and Adjudication Act and applicable GST provisions.
